Terms of Service

These Terms govern your use of BoardDesk (“the Service”). By creating an account or using the Service, your board agrees to these Terms.

The Service

BoardDesk is software for the operational management of HOA, co-op, and condominium boards — including decision logging, project tracking, bid comparison, document storage, meeting scheduling, and a resident transparency portal.

Roles & responsibilities

Your board is the data controller for the information it manages, including resident information. BoardDesk acts as a data processor, processing that information on your board’s behalf and instructions (see our Data Processing Agreement).

Records retention & compliance

Your board is responsible for compliance with applicable record-keeping laws, including New York Business Corporation Law §624. BoardDesk retains decisions and minutes permanently and prevents hard deletion of those records to support compliance, but your board remains responsible for the accuracy and completeness of its records.

Billing

The Service is offered with a 90-day free trial, after which it is billed at $39 per board per month. Applicable taxes are calculated at checkout. Fees are non-refundable except where required by law. You may cancel at any time through the billing portal.

Acceptable use

You agree not to misuse the Service, upload unlawful content, or attempt to access data belonging to other boards.

Limitation of liability

To the maximum extent permitted by law, BoardDesk’s total liability arising out of or related to the Service is limited to the fees paid by your board in the twelve (12) months preceding the claim. The Service is provided “as is” without warranties of any kind.

Governing law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules.

Changes

We may update these Terms; material changes will be communicated to board administrators.
